Rawalpindi: More than 790 accused/workers of Pakistan Tehrik-e-Insaf (PTI) and Pakistan Awami Tehrik (PAT) are released and discharged from the charged under section 188 PPC from the court of duty judge Hafiz Shahid Javed Learned Duty Magistrate Rawalpindi on Sunday afternoon.

All accused were produce by local police from Rawalpindi District 30 police station.

On behalf of accused Advocate Asghar Ali Mubarak appeared and argued before the duty judge court on Sunday.

The accused persons in police custody present in the duty judge court, at this occasion the Investigation officers along with record appeared and requested for the 14 days judicial remand of the accused persons.

Advocate Asghar Ali Mubarak argued that the accused were arrested illegally and detained by the local police. The accused were remained into the custody U/S188 PPC for violating section 144 PPC.

He said that it is clearly mentioned in the law that no court on account of bar contained U/S195, (1), (a) Cr.PC can take cognizance of an offence punishable U/S 188 PPC, except on complaint in writing of concerned.

He said that the record shows that there is no complaint regarding the offence. Further he stated that the all accused were arrested by the police and there is no written order of competent authority.

The knowledge of all accused regarding the promulgation of the orders of competent authority’s are not established before the court even no notification of said orders have been produced in the court so all the accused are entitles to discharged from the charged and immediately released.

After argument the duty judge order all accused discharged immediately released. At this occasion accuse made sign of victory and slogan GO NAWAZ GO.
